August 24, 2013. Linn Deputies arrest two on Home Invasion Robbery, Attempted Murder


August 24th, 2013 7:20 PM — Linn County Sheriff Tim Mueller reports on August 23 at 1:24 a.m., the Linn County Sheriff’s Office received a 9-1-1 call from 67 year old Wanda Lea Foster of Lyons, report ing she had been tied up and robbed at her residence at 47065 Lyons Mill City Drive.

Deputies arrived at the residence and found the suspects had fled the location. Deputies located John Ivan Bach, 75, unconscious in a bedroom of the residence. Mr. Bach was bound in a way that his airflow was restricted and he was unable to move.

Paramedics from the Lyons Rural Fire District transported Mr. Bach to the Salem Regional Health Center where he was treated for his injuries. (No further information is available regarding either victims’ condition.)

The home is owned by Mr. Bach and Mrs. Foster rents a room from him.

While deputies were processing the residence for evidence, the Salem Police Department notified them that a 1995 Dodge Ram pickup belonging to Mr. Bach had been involved in a hit and run crash with another vehicle in downtown Salem. The driver of the vehicle hit by Mr. Bach’s pickup was transported to the hospital and treated for injuries sustained in the crash. Salem Police found Mr. Bach’s pickup abandoned near the location of the hit and run incident.

Through the investigation, deputies found Wanda Foster had allowed the three assailants into the residence where they assaulted Mr. Bach. One of the assailants brandished a pistol during the attack although no shots were fired. After Mr. Bach was assaulted and bound, the assailants then stole his wallet, household items, and the Dodge pickup they used to flee the scene. The victims were known by the suspects and this was not a random attack.

On August 23 at approximately 5:30 p.m., two of the assailants turned themselves in at the Linn County Sheriff’s Office Substation in Mill City where they were taken into custody and transported to the Linn County Sheriff’s Office in Albany.

Jonathan James Foster, 31, of Mill City is charged with Attempted Murder, Kidnapping I, Assault II, Robbery I, Theft I, Burglary I, and Unlawful Use of a Motor Vehicle. Foster is the son of Wanda Foster who reported the incident.

Justina Jean Chilcote, 24, of Mill City, is charged with Attempted Murder, Kidnapping I, Assault II, Robbery I, Theft I, Burglary I, and Unlawful Use of a Motor Vehicle.

Both suspects are lodged at the Linn County Jail.

The third suspect, David James Gonzales Jr, of Mill City, has not been located at the time of this release. He is described as 6’02” tall, approximately 220 pounds, with red hair and blue eyes.
